By accessing or using Pushpod.net (the "Service"), you agree to be bound by these Terms of Use ("Terms"). Please read them carefully.
These Terms constitute a legally binding agreement between you and Pushpod.net. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
PushPod converts audio files stored in your own connected cloud storage accounts (Google Drive, OneDrive, Dropbox, or Box) into podcast RSS feeds. The Service indexes the names and metadata of the files in your connected storage, generates a feed from them, and lets podcast apps access that feed. Your files remain in your cloud storage at all times; the Service does not host or copy your audio content.
You understand and agree that you are solely responsible for ensuring that any content you distribute through the Service does not infringe upon the intellectual property rights, including copyright, of any third party. Pushpod.net does not monitor or control the content distributed by users and, to the fullest extent permitted by applicable law, expressly disclaims any responsibility or liability for any distribution of copyrighted material or other intellectual property infringement that may occur through the use of the Service. You agree to indemnify and hold Pushpod.net harmless from any claims, damages, or losses arising out of or related to your distribution of content that infringes upon the rights of others.
Feeds you create are served at unlisted web addresses. "Unlisted" means the address is not published or searchable through the Service — anyone you share the address with can access the feed, so treat the address like a secret and share it only with people you intend to have access. You are responsible for who you share your feed addresses with.
Some features of the Service require a paid subscription for full access. Payments are processed by Stripe; we do not receive or store your card or banking details. Subscriptions recur on the billing cycle shown at checkout (monthly or yearly, as displayed at the time of purchase) and can be managed, changed, or cancelled at any time via the Stripe Customer Portal; cancellation stops future charges. If a payment is subject to refunds or a statutory guarantee under Australian Consumer Law, those rights apply in addition to these Terms.
You agree not to: use the Service to distribute content you do not have the rights to distribute; attempt to access feeds or accounts that are not yours; probe, scan, or test the vulnerability of the Service; interfere with or disrupt the Service or the infrastructure it relies on; or use the Service in violation of applicable laws or the terms of your cloud storage provider.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PUSHPOD.NET AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT PUSHPOD.NET HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
You acknowledge and agree that Pushpod.net personnel may access user accounts and data — including by signing in to an account under administrative impersonation — solely for the purpose of debugging, resolving technical issues you report, and ensuring the proper functioning and security of the Service. Such access will be limited to what is necessary for those purposes, and we will take reasonable measures to protect the privacy and security of your data during such access.
You may stop using the Service and delete your account at any time from your account settings; deletion removes your profile, feeds, and stored storage connections from our systems. Pushpod.net may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if you breach these Terms.
Pushpod.net reserves the right to modify or revise these Terms at any time without notice. By continuing to access or use the Service after any such modifications become effective, you agree to be bound by the revised Terms. It is your responsibility to review these Terms periodically for any changes.
These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.
These Terms constitute the entire agreement between you and Pushpod.net regarding your use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
